IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT PAID BY YOU TO KYR SCALING LLC IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. KYR SCALING LLC DOES NOT WARRANT THAT SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
You agree to indemnify, defend, and hold harmless KYR Scaling LLC and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses arising out of your use of our services, your violation of these Terms, or your violation of any third-party rights.
KYR Scaling LLC reserves the right to suspend or terminate your access to our services at any time, with or without cause, and with or without notice. You may terminate your use of our services at any time by discontinuing use and contacting us to close your account.
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Dallas County, Texas.
